Better late than never

Opel, Peugeot, DS and Citroën have launched Sjoemeldiesels from 2009. The court in Amsterdam judges that.

Opel, Peugeot, DS and Citroën have brought so -called “Sjoemeldiesels” to the Dutch market since 2009 – Minus Opel then under the flag of Groupe PSA. The court in Amsterdam judges this in cases that have been brought by three claim foundations.

Those diesels were equipped with software, which means that the emission of harmful substances during tests was lower than when used on the road.

According to the court, the nitrogen emissions of those diesel cars were too high in practice and the applicable rules were not met. The court states that it is an interim judgment and that the proceedings continue. For example, the court still has to consider whether the defendant parties are liable for marketing the tamper diesels.

The claim foundations want to enforce compensation from Stellantis for thousands of car owners with lawsuits. This concerns Diesel Emissions Justice Foundation and Stichting Car Claim that collaborates with the Consumers’ Association.

“This is a breakthrough in the field of cheating software,” says lawyer Joost Edixhoven of Emissions Justice. “We also expect similar decisions from manufacturers such as Mercedes, Fiat and Renault. With this verdict, compensation finally comes into the picture.”

“We call on Stellantis to take this clear verdict seriously and finally talk to us about a just solution,” said Guido van Woerkom of Car Claim.
